Lawyers in Canada are increasingly warning their clients about the perils of posting information on social websites such as Facebook after a small but growing number of cases faltered because of damning messages and photographs.

Last month, a Newfoundland man's lawsuit was largely foiled, partly because of Facebook postings that contradicted his claims.

Lawyers in Canada are increasingly warning their clients about the perils of posting information on social websites such as Facebook after a small but growing number of cases faltered because of damning messages and photographs.

Last month, a Newfoundland man's lawsuit was largely foiled, partly because of Facebook postings that contradicted his claims.

Dennis Terry filed the suit after suffering whiplash from two car accidents in 2001 and 2003. In addition to other losses, he argued the injuries harmed his social life, claiming his friends stopped phoning him to go out after he repeatedly declined their invitations.

At one point, Terry testified he had trouble playing pool - a pastime he often enjoyed with friends - because he was unable to bend over the table after making a couple of shots.

But after defence lawyers produced evidence from Terry's Facebook profile that suggested a life brimming with activity, provincial Supreme Court Justice James Adams concluded the plaintiff exaggerated the toll his injuries took.

"He went to and hosted parties, attended weekend outings at summer cabins, drank alcohol frequently, smoked marijuana daily and appeared to have a number of friends with whom he communicated and socialized on a regular basis," Adams wrote in his April 17 ruling.

"I find it incredible that Mr. Terry's social life miraculously improved in the few months he was communicating on Facebook and that for the remainder of the time from 2001 to 2007 he essentially had no or little social life. Without this evidence, I would have been left with a very different impression of Mr. Terry's social life."

After defence lawyers confronted him with the Facebook evidence, Terry closed his account.

He was awarded $40,000 in general damages and suffering, but the judge rejected his other claims that sought up to $1.3 million.

Terry and his lawyer declined to comment on the case.

It's one of a few across Canada that highlights how information posted on Facebook or other social networking sites, including MySpace and Twitter, can come back to destroy a case under the scrutiny of a courtroom.

In February, Ontario Superior Court Justice David Brown ruled that a man suing over injuries from a 2004 car accident must submit to cross-examination from defence lawyers about postings on his Facebook account, including content not available to the public.

"To permit a party claiming very substantial damages for loss of enjoyment of life to hide behind self-set privacy controls on a website, the primary purpose of which is to enable people to share information about how they lead their social lives, risks depriving the opposite party of access to material that may be relevant to ensuring a fair trial," Brown ruled.

Brenda Hollingsworth, a personal injury lawyer in Ottawa, says uncovering as much information as possible about potential clients has become part of her vetting process before taking on cases.

"I now routinely Google my own clients just to let them know what's on there and to make sure that I'm not surprised," Hollingsworth said.

"As these decisions come out, lawyers clue in that we have to warn our clients about this, and I'm willing to bet that (for) most personal injury lawyers, that's part of their opening pitch to prospective clients: 'Don't be an idiot about what you put on Facebook.'"

    insurance scamming has become a way of life for a large group of individuals who jump at the opportunity to win the auto loto by claiming large amounts for non existant injuries. They should be fined or jailed or both when they are caught also doctors who condone this should be fined.

    To all those who think they can bash others on this facebook, and other sites or public forums. Beware of what you post. It may come back to bite you. False and defammatory comments about one can result in the victim looking for justice. The owners of such sites are obligated to work with the legal authorities when asked to do so thus hiding behind a keyboard won't protect you from what you post. This is a reminder to those who think they are getting away with it. These idiots need to be held accountable and exposed.

    Graham - What does Danny Williams have to do with this article.

    I seem to recall that Mr. Williams won by a landslide of votes from Newfoundlander's, not Cubans or Russians.

    Well after they pulled him from his car with the jaws of life, im sure his first thoughts were about money, or the guy who just hit him doing 80 while on his cellphone.

    The internet, where anyone can be anyone they just have to set it up right.
    Now personally I like to post picure of friends in pain all the time, its how I keep my friends, they like that.

    Enough of my sarcasm now.

    Yes I am a friend of this man, You see. Facebook brought our friends back together, it was a communication tool so we could arrange get togethers, like party's or sports, or even just for supper.
    In most of his pictures (taken at his house, and one other friends) he is sitting. We Don't call him to play golf with us, he doesnt come to the weekend hockey tourneys, Hell if we dont go to his house we dont see him.

    So two years ago, thru facebook all of our highschool friends got together about 10 - 12 times. Since then its very rare that we will get together.
    So before we all call him a scam artist, and all the other nasty comments, how about we ask him to hold up his hands? Oh wait he cant, ask him to help you move in your new fridge, oh he cant......how about help you work on you car, after all he is a certified mechanic.....oh he cant because he is in pain.

    So its because of bad drivers that your insurance premiums are thru the roof and because of scam artists that the honest people, like my friend here, get the short end of the stick.

    When you put up pictures do you put the ones up of friends in pain.

    Just goes to show that the vast majority of these lawsuits are a farce and we have to pay higher insurance rates because of it. Why did they give him $40000 he should have to pay it back what a joke.

    Remember folks there are always two sides to every story... The part about on his profile drinking beer and smoking dope, wouldn't you if your life was in a whirlwind...thats not strenuous activity...He probably had to do that to kill the pain...just food for thought..

    You'd have to be a moron to dump all of your life information into something like Facebook. Who you are, where you are, what you do, who you know, what you look like. There are just so many ways it can come back and bite you in the rear end, both for people like this guy and for those who haven't done anything wrong, like victims of identity theft.

    I wouldn't touch Facebook with a ten-foot pole.

    I have seen polls on Facebook asking what we think of Danny Williams. People from every corner of the planet can vote. No wonder he is so popular he has the russians and cubans voteing for him. he is a leader they can relate too.

    It is people like this that make it hard for people who are really hurt to get compensation. My wife's aunt is one of the ones who milks the system and then brags about how much she won . She couldn't believe that I returned to work shortly after a rear end collision. Said it was going to limit my claim! Makes me sick!

    Maybe the reason that everyone's insurance has gone up so much is that some people drive around on cell phones and cause car accidents. This was the case in one of the above accidents, which conviently was not mentioned in the article. I find it sad that people are so quick to judge without knowing both sides of the story. I hope for those people they never find themselfs in the same situation as my friend is now in.
