Reveals new contradiction in judge's decision

I am pleased to observe that CBC Radio is following the Father Wayne Dohey story today. There is much about Judge Porter's decision that causes me concern, and I feel there are definitely grounds for an appeal. In addition to the points made in my recent blog item on this subject, reporter Mark Quinn brought out an additional, critically important detail.

In his decision, Judge Porter questioned the credibility of the complainant. In that same decision, he cited case law that said a preliminary inquiry "does not require a judge to assess credibility."

That's quite a contradiction, in my view.

The complainant's allegations are serious enough to warrant a trial. I hope she gets her day in court.

Please note: I will be preoccupied for a few days with some pressing client deadlines, and will post sporadically until I can catch up. Thanks for your patience!
