The man accused of sexually assaulting a female Memorial University student last month is hoping his luck will change.
And he's not taking any chances.
Farhood Azarsina, a native of Iran, made a brief appearance in provincial court in St. John's Tuesday to face one charge of sexual assault.
Dressed in dark pants and a vest, a white shirt with a blue-patterned satin tie, and blue sneakers, the 25-year-old stood in court as lawyers agreed to set his case over until next month for a plea.
The case was going to be called again Nov. 13, but Azarsina doesn't like the bad luck associated with the number 13.
"I'd prefer not to appear on the 13th," he told Judge David Orr. "I don't like that number."
The request drew grins from the handful of people in the court room and even smiles from some lawyers.
Orr consented and scheduled the next court date for Nov. 14.
"Thank you," Azarsina said, smiling and nodding his head. "That's much better."
A PhD student in engineering at MUN, Azarsina allegedly kissed a 19-year-old female student's breast in an elevator in the University Centre on Sept. 27.
According to media reports, Azarsina referred to the incident as "nothing serious."
He's free on $5,000 bail, has handed over his passport and is ordered to stay away from any building in which the woman has classes.
He was banned from campus for 10 days while the university conducted its own review.

Asks judge to reconsider court date set for the 13th

Isnt it interesting that if a woman is not covered from head to toe in Iran, a war may just break out but a male Iranian citizen can assault a Canadian woman and it's no big deal . It'd be a good idea that he finish his studies by corespondence while in a prison cell....no big deal!

So now we have foreigners dictating to our legal system their preferences for treatment. Just like he mocks the incident, this person mocks our legal system - shame on us for tolerating this. Certainly we would not be accommodated so before Iranian courts.

In my opinion his luck ran out the day he assaulted that woman in the elevator. Imagine the justice syatem bending in any way for this man due to this own superstitions. I think he has much bigger worries coming to him. To me it would be no big deal if he spent the rest of his life in prison. Numbers and voodoo will not help him now. I hope he gets the book thrown at him.
