Old crimes, fresh wounds

Father James Hickey is long dead, but some are still seeking closure

Almost two decades after his death, Father James Hickey’s legal and moral legacy lives on.

There are still a dozen outstanding claims against or involving the pedophile priest, who, in September 1988, pleaded guilty to 20 charges of sexual assault, gross indecency and indecent assault involving teenage boys.

“They’re at a snail’s pace, is what they are,” St. John’s lawyer Greg Stack said of the cases.

His firm represents the 12 victims.

Hickey was sentenced to five years for his crimes and sent to the federal penitentiary in Dorchester, N.B.

His case was a watershed because a high-profile priest had been charged. Other charges against Catholic clergy followed, as did the Winter Commission, a church-led inquiry into the sexual abuse of children by clergy.

 

Royal commission

Around the same time, revelations that Mount Cashel Orphanage residents had been sexually abused by their Christian Brother caretakers surfaced, and prompted a royal commission.

The abuse scandals had the whole province agog throughout the late ’80s and early ’90s.

Hickey died in 1992.

A number of the boys he preyed upon have sought compensation and many were part of a 1997 settlement.

Stack said the priest’s victims have had little success since then, even though most had filed complaints against Hickey with the police and thought they would have been included in the original agreement.

“It’s like someone got the reins hauled in on us,” he said.

Stack began representing Hickey’s victims in February 1989.

Four current cases are before the courts, but no judgments have been made.

In the other eight claims, the victims were found to be entitled to compensation, but the amount hasn’t been determined.

There had been 11 victims in this latter group, Stack explained, but two have been compensated and another is awaiting his money.

Stack said the lawyers are discussing the files weekly, but the process crawls along.

“The legal representatives for the church are certainly dragging this out,” he said. “Why? I don’t know.”

St. John’s lawyer David Hurley is representing the church’s insurer, which is responsible for eight of the claims.

He couldn’t offer a reason as to why the settlements are taking so long.

“We’re hoping to get them all finished this year, if possible,” Hurley said.

The significance of the recently surfaced 1997 letter from the Vatican asking Irish bishops not to report sexual abusers to the authorities is not lost on Stack.

Similar letter could account for delay

He wonders if Rome sent such a letter to the St. John’s-based archdiocese that year, especially since the settlement of claims has almost come to a halt since then.

“Whether it’s something from the Vatican we may never know unless we get a WikiLeaks-type letter,” he said.

“If there’s a comparable letter that could account for (the delay in resolution here), I don’t know.”

Stack said the slow pace is disappointing for him and baffling for the victims.

“They are very frustrated with it,” he said.

According to Stack, approximately 50 of Hickey’s victims have sought compensation

Some of the claimants who were part of the 1997 settlement have found closure and “have put it behind them remarkably,” he said.

Others who were part of that settlement haven’t been so fortunate, he added, noting that one of them was hospitalized this past year.

“And it’s all psychiatric problems that stem from the Hickey matters. A couple of the victims have tremendous difficulty coping with life, just general life, as a result of what this did to them.”

Stack doesn’t believe all of Hickey’s victims have come forward and he said the length of time it’s taking to resolve claims isn’t going to prompt them to act.

Still, he doesn’t think the slow pace should deter someone who Hickey preyed upon from taking action.

“It depends on the individual. If they’re troubled by it, it does still provide closure to address it,” Stack said.

“It’s saying, ‘I’m not going to let this person get the better of me. I was a victim and I deserve compensation. ... But I also want acknowledgement that I was a victim. I want the church to be aware that I was a victim.’”

Stack said he’s sure the victims who’ve come forward have helped the church reconsider its situation and what it’s doing to the faithful.

“Because the victims, by and large, were the most faithful Catholics. I think a lot of good people in the church are for disclosure and against what was in the papal letter that was recently disclosed.”

Attempts to reach the Roman Catholic Archdiocese of St. John’s and its legal counsel were unsuccessful.

    i still wake up most nights in a panic and its' not getting any easier as the weeks and months go by . i've been on a emotional roller coaster for a long time. Sometimes iI wish that i had finished what i set out to do 15 years ago. i've talked to the bishop and the lawyers that represent the church as well and all i got from them was one lie after another and they were to naive to see that i could see through the lies they were telling me. The bishop wants this to go away but dont want to compensate the victims,and the lawyers dont want it to end because it been their meal ticket for years.The church paid more to the lawyers then the victims will ever receive I was.raped at 12 years old and still being raped as a adult.

    My aunt, who is a retired nun in the sisters of Mercy,sticks up for Father Hickey, who is thankfully dead (I wish I had been in the cell with that sick Bastard he'd have been dead a lot sooner) every time his name comes up.I asked her why she sticks up for the sick puppy so vehemently at every mention of his name and she astoundingly told me that he had suffered enough.I couldn't believe my ears! I told her that had I been a priest in that order and had known about what Hickey was doing with these children I would have killed the bastard myself and happily would have went to prison for it..She went ballistic on me.I haven't spoken to her in 5 years.Like a lot of the upper echelon clergy in the Catholic church, she's in complete denial.As if the lives of the children that were molested by Hickey just don't matter!How Appalling is that, and from a sister of Mercy.What a misnomer. I don't know what's to matter with the court system up that way?All of the children that were likewise debauched by sick perverted priests here in the US at about the same time as it happened up that way, have long ago gotten their settlements.In fact, the Catholic church in Louisiana alone have had to sell most of their church property to settle the claims to the tune of about 500,000,000 dollars for the victims.I think it's a travesty of justice what's going on up there with this case.Haven't you guys heard of a speedy trial and settlement?It's the bull work of our legal system here in the US.Maybe you should study the concept.It works for us. I do wish all the litigants in this case good luck and hang in there.You may even live long enough to see the settlement?And make no bones about it that's what those lawyers are up to.They want the victims to die from old age and other means so they won't have to pay out as much.What a joke!

    Have to agree with comments of Steve AND if it weren't for lawyers who represent abuse victims, (Like the 'Ranting Greg Stack") how would any institution be held accountable (We see it in the RC church, schools). Why hold onto any damage settlements for victims so long? Are the church, schools telling their hired lawyers how to stall or is it for the lawyers benefits?! Settle because it,s the right thing to do, make it right!

    I am very tired of this seemingly never-ending turmoil. My heart goes out to all victims of sexual abuse and I pray that they will find some kind of comfort, as difficult as I think that will be. When it comes ot the court cases, I am at a loss. If a charge has been laid and a conviction determined, why should it take years to resolve. Surely the court can impose a financial settlement and other remedies and surely it can also impose a time frame for this being completed. If the church does not comply within the time frame dictated by the court, then someone who has authority and responsibility for meeting that time frame should be charges. Enough of this already. Let's permit people to get on with their lives. If, on the other hand, convictions have not been determined, I think Mr. Stack should follow some of the standards he would like to impose on the media and police that he put forth earlier this week.

    The whole process is one of re-victimization and there is no guaruntee of compensation. I know of what I speak. Tim Buck Two - you appear to have no understanding of what the victims of abuse have and are going through. Do you really think that anyone wants to be part of a long drawn out legal battle that continuously reminds them of the abuse they experienced. Do you really think that their Lawyer is somehow using them to destroy the 'church". Believe you me, everyone wants this to be over - however, the RC Church and it's appointed/hired representatives drag it on and on and on.

    Tim Buck Two - I had to read your submission a couple of times to make sure I wasn't missing something. How you can construe that this is some sort of a hate campaign on behalf of the this lawyer and the newspaper is mind blowing. He has been representing some of these victims since 1989 and they are still not resolved. I think that sometime in the past 22 years the catholic church, if only in the name of compassion, they should have done everything in their power to try and settle these law suits as quickly and efficiently as possible. Unfortunately when it comes to the - management - of the catholic church it is being run like any other large corporation. Minimize your losses at whatever cost. The only thing is what you see is continued human suffering at the hands of a church no less!

      Tim Buck Two - Nobody is trying to destroy the RC CHURCH. If anything, it was the lives of those boys (now men) that were destroyed. And they should have been compensated long ago. And yes, this whole thing is endless......endless for the victims, they probably want this ended more than anybody, because the longer it drags on, the longer they are reminded of all the horrible things that had happened to them , they have bad memories being surfaced up all the time because of all this .... at least if it was all resolved, and they were compensated, as they so rightfully deserve, they could try and put everything past them instead of having constant reminders of the EVIL that was done to them.... And The Telegram and Stack should 'HARP' on this until each and every victim gets their justice !! MY THUMBS UP TO THE TELERAM AND TO STACK FOR THIS !!

    The guilty priest is dead. Many of the victims have received financial assistance and the fact that some have yet to be fully dealth with is indeed a shame It should be cleared up at once. Those of us who must listen to the continuous rant of LAWYER Stack and see the 20 year old picture of Hickey distributing the Holy Eucharist on the front page oft the newspaper find the whole situation to be endless.in its coverage and maybe has just come to the point where I wonder if the real intention of this story is to destroy the RC CHURCH in this province. Whatever the reason/s it will not drive me away from the RC Church but I do feel pity for Stack and the Telegram who I guess have to harp on this untill they feel they have brought the RC Church to end of its days. I would not hold my breath waiting for that to happen as many who have remained with the RC Church and the good clergy we still have serving us know that Stack,the reporter and others from the Telegram who promote this intense hate campaign will also someday have to answer for their action Go figure.

      Good on The Telegram for showing the "20 year old picture of Hickey" on the front page. We need to be reminded of the ongoing suffering of his victims as well as the fact that most have not yet been financially compensated. Thank Goodness I myself have never been a victim of sexual abuse. But my heart goes out to those boys (now men) who were victimized. The Catholic Church has no one to blame but themselves for any bad press regarding this issue. There have been far too many cover ups on their part. I know there are a lot of good individual RC people (including priests), but the bigwigs in the Church hierarchy have proven to be pretty un-Chrstian in terms of taking responsibility regarding this matter.

    THE COURTS ARE JUST AS BAD,IF NOT WORSE,TO KEEP THIS THING DRAGGING.DON'T THEY REALIZE,THESE (CHILDREN) NOW ADULTS NEED CLOSURE TO THEIR PLIGHT. WASN'T BAD ENOUGH FOR THIS TO HAPPEN TO THEM,LET ALONE TO BE REMINDED OF IT EVERY WAKING DAY. MONEY WILL NEVER TAKE AWAY THE MEMORIES,BUT IT WOULD GIVE THESE VICTIMS A SENSE OF KNOWING THEY WERE NOT TO BE BLAMED FOR WHAT HAPPENED,AT THE HANDS OF THEIR PREDATORS.
