Restrictions to be imposed on psychiatrist’s medical licence

Psychiatrist Dr. James Hanley will be allowed to re-apply for a medical licence in Newfoundland.

A tribunal agreed this morning to a joint submission from lawyers for the College of Physicians and Surgeons of Newfoundland and Labrador and Hanley on restrictions to his licence.

He will be required to complete re-entry training, agree to not work in a private practice and pay monthly amounts of $500 beginning in January 2012 to pay his portion of two tribunal hearing costs amounting to $22,500.

A summary of the decision will also be included in any certificate of good standing.

Hanley admitted in 2005 to having a sexual relationship with a female patient. He lost his licences to practice in Newfoundland and New Brunswick in 2007.

    he should never be allowed to practise again. He took advantage of a vulnerable person and he was in a position of POWER! I would not want this man teaching and role modelling for ANY future person treating patients. I'm sure he has helped many people in the past, but one "lapse in judgement" is one too many when you are in this type of profession. It is not simply human error, as he has a professional obligation to uphold, and one of those obligations is NOT having sexual relationships with the vulnerable population in his care. He should have thought about his career and the implications of his unhealthy decisions before breaching his professional conduct and having an inappropriate relationship with a patient. YOU DO THE CRIME, YOU DO THE TIME! ...just like everyone else.

    In response to "concernedforsociety", you obviously have not been Dr Hanley's patient. If you were you would be in support of this dr, who gave so freely of his time, saved the lives of so very many, is an honorable man and dr, who told the truth! He is a human after all & has made a mistake. He didn't prescribe narcotics or other seriously addictive medications that would hurt, he quite simply made a mistake. I am a former patient who continues to have severe life altering Depression. The only time that my illness was controlled was when I was under the care of Dr James Hanley, who listened and gave me all the time i needed before dispensing prescriptions. I have had more recent care, but the Psychiatrists that i have seen since,had a nurse take my medical history, saw me for 5 minutes while he prescribed medications referred me to a "mental health team" made up largely of persons that admitted had little to offer because they weren't trained to counsel me. Dr Hanley should be given back ALL his privileges. He is one in a million and I would advise anyone with a mental illness to seek to be his patient. I would stand in line to be afforded the opportunity to have him back as my Dr. I ask that all of you that have been helped by Dr Hanley to show him your support!!

    Former Patient: I am certainly in full agreement with the decision of the College and feel it is well over-due. In our society, people from all walks of life, make mistakes which are fogiven and forgetten in short order. Why this event was given such a level of importance is beyond me. Dr. Hanley saved and improved the lives of thousands of people in this province and outside of it!! As a former patient of his, I was always treated with the utmost respect and my life was tremendously improved as a result of Dr. Hanley's care. It is with gratitude to him that I say congratutlations on this victory!!!

    How soon we forget the good this man had done for his patients. I hope that the College of Physicians will see fit to allow Dr. Hanley to practice again. To err is human, to forgive divine. Dr Hanley I sincerely hope that you get the opportunity to help future patients as you have helped me. God bless.

    I think Dr. Hanley has suffered enough for his mistake. No doubt he made a big mistake professionally and personally because he was a family man. He is a human being and if there is anyone out there without sin let them cast the first stone. Just as I thought.....My friend was treated by Dr. Hanley very professionly, did very well since. There is no doubt if the need arose again for a referral she wouldn't hesitate to ask for Dr. Hanley, if it were possible. Give the man a chance.

    thank goodness, that dr. hanley's medical peers decided to give him back his license.....i am a former patient and fully support his return...glad that he will be available to help another patient back to better health. he has saved countless number of lives. mine included. he made a poor decision to 'accept and give' another patient too much of his precious time. i doubt he would have gone near her, should he have thought twice. it is human to err. he also accepted full responsibility for his wrong doing. on the other hand, if he decided to tell tales outside of his practise, he could certainly speak of others, who in the medical practise has done the very same thing, but he is too honorable to do that.. remember the oath he and others took to keep to medical records to themselves forever. i wish dr hanley well. their are people who need your help and would greatly have you for their doctor. to those who choose to not support him, it is your loss and your right to do so.

    I think it's time for Dr. Hanley to be allowed by the College Of Physicians to return to practicing again. He's helped so many people in the past and I'm sure one indiscretion can be forgiven, after all he is human and we all err in our ways. It wasn't some child involved...2 consenting adults.. I for one, would say a second chance is long over due.

    I think this is irresponsible on the part of the Colleg of Physicians to put this man back in a position to advise society's debilitated looking for help. Perhaps he should be required to disclose his past indiscretions to his new patients. I would not be impressed if my GP referred me to this guy.
