The Newfoundland Supreme Court of Appeal today ordered a new trial in the case of Nelson Hart who had been convicted in 2007 of murder in the drowning deaths of his twin three-year-old daughters in Gander Lake on Aug. 4, 2002.

The appeals court unanimously stated that a new trial should be ordered because Hart, in light of his tendency toward epileptic seizures and his difficulty in thinking and speaking clearly under stress with a large number of people around, should have been permitted to testify with the public excluded from the courtroom, but with audio or video transmission to those outside.

Also, the decision states, a majority decision by Chief Justice Derek Green, with Justice Michael Harrington concurring, ordered a new trial because the evidence of confessions obtained from Hart as a result of police pretending to be criminals in a “Mr. Big” sting was obtained by improper coercion and inducements in breach of the Charter of Rights and Freedoms, and should not have been admitted at the trial.

Justice Leo Barry dissented finding no excessive coercion or abuse of process and would have admitted the Mr. Big evidence.

Hart was convicted on March 28, 2007 of two counts of first-degree murder by a jury in Newfoundland Supreme Court trial division.

    This is why we have appeal courts so that everyone is treated fairly under the law. If there were improper tactics used by the police then a new trial is a must regardless of public opinion. I'd rather spend the money today on a re-trial then to spend millions years from now if the accused were to be found innocent...I beleive we have had far to many cases in this country in the past where people were innocent but spent years behind bars...

    I agree. ANOTHER waste of taxpayers money. this man is not worth it. I thought he was locked up and the key thrown away - as it should be. All this money wasted on him and a new trial and a poor cancer patient can't get the drugs and treatment they need. our seniors are neglected and living in hardship and this man gets another trial!! Plus how much money has already been wasted in researching this and coming to this conclusion! We are too seriously out of whack.

    The Justice system is not in place to serve justice to the victims, Its clearly protects the criminals. Got to love the Criminal Code of Canada. Its easier to get off with murder then it is a speeding ticket

    An absolute farce. What loving parent in their right mind would leave their child at any age drowning and go and drive for help. He should rot in prison like the scum he is. Despicable. Our joke of a justice system protects the criminals again. But don't poach a fish or kill a moose though or lose everything you got. What a travesty

    Soooo right Marg! No one cares about the poor little girls just his rights................. poor guy has some medical problems so it is all right to kill his children is what I read into it. What do you expect from Political Appointments as Judges - Good Ole Boy Network. Judges should be elected and answer to the people.
