A Conception Bay South woman who swindled thousands of dollars from her friend was sentenced to nine months in jail today when her case was called in provincial court in St. John’s.
Katherine Fagan, 39, will also be subject to a year of probation upon her release and she has been ordered to pay more than $21,000 in restitution.
Fagan pleaded guilty to fraud and forgery charges in August.
The frauds involved use of her friend's MasterCards from Bank of Montreal, MBNA and Canadian Tire, while the forgeries relate to reportedly forging the credit card applications. The offences are said to have happened between February 2011 and February 2012.
Fagan’s lawyer, Robin Reid, had asked for an 18-month conditional sentence, but Crown prosecutor Shawn Patten said jail time was warranted in the case.
Judge Mike Madden agreed with the Crown, noting that this was Fagan's second fraud conviction in the last two years.
In March 2010, she was convicted of fraud over $5,000 for swindling thousands from her former employer, Vision Packaging. In that case, she was also ordered to pay restitution, as well, to which she's paid $4,000 so far.

I went to school with this person. My heart breaks for her. She is a good person. She obviously has a problem, a sickness. She is responsible for what she did and should have to repay, but she should be offered help, so she wont do it again. She is a mother, daughter, sister and friend.
