At approximately 11:30 p.m. Wednesday two off-duty RNC members observed a man who appeared intoxicated behind the wheel of a parked car in the downtown area of St. John’s.

The off-duty officers approached and spoke to the man and prevented him from moving the vehicle while waiting for a patrol vehicle to arrive.

Charges against the man include having care and control of a motor vehicle while his ability was impaired, refusing to provide a sample of his breath for analysis, assaulting a police officer, uttering threats to cause death, and breach of probation.

He was taken into custody for a court appearance today.

You are allowed to sit in the drivers seat of a car, just not allowed to drive. A friend was arrested for drunk driving while parked in his car in front of his house. He either lost his house keys or his wife sent him to the dog house. To keep warm, he went to sleep in the car. The police arrested him for drunk driving. He went to court, pled not guilty, explain the situtation and was found not guilty. I wonder is this is the same tyoe of case here.
