Cabinet documents in moose-vehicle class action not protected, lawyer says

Cabinet documents in a moose-vehicle class action are not protected by immunity and must be given to lawyers for the plaintiffs, a judge ruled Thursday, lawyer Ches Crosbie said.

Crosbie said that tight restrictions have been placed on who can see the secret papers, and if they come up for discussion at trial, the trial must be closed to the public while they are discussed.

Justice Valerie Marshall of the Supreme Court, trial division gave her decision in the afternoon after lawyers argued the matter.

Crosbie said there is a date next week set to meet and start planning for a trial.

 “I am hoping it can start in September,” Crosbie said.
