O’Quinn, accused murderer Green face one charge each over Waterford Hospital incident

An accused murderer and his alleged co-conspirator will be the subjects of a four-day trial in November to determine whether or not they were planning to escape lawful custody earlier this year from a mental health facility in
St. John’s.

Kenneth Edward Green, 35, and Matthew Francis O’Quinn, 37, each face one count of conspiracy to escape from lawful custody. They were reportedly planning to escape through a window at the Waterford Hospital while both men were staying there in March.

Green is charged with second-degree murder in connection to the death of Joey Whalen.

The victim was severely beaten inside a home on Tessier Place in

St. John’s on March 13 and died in hospital four days later. The Royal Newfoundland Constabulary arrested the Mount Pearl man on March 18.

Green did not appear in St. John’s provincial court Thursday morning, but lawyer Randy Piercey was there on his behalf. O’Quinn, who is from Corner Brook, appeared by video link from Her Majesty’s Penitentiary.

Piercey initially intended to act on an application he filed to have Green’s case severed from O’Quinn. However, he said Thursday this would not be necessarily so long as O’Quinn and his new lawyer, Tim O’Brien, are ready to present their case when the trial begins Nov. 18. The trial is expected to last four days, Nov. 18-21.

O’Brien told Judge James Walsh they will indeed be ready for the Nov. 18 date.

Walsh suggested Piercey need not withdraw his filed application, leaving him the option to follow through on it at a later date if a further delay presents itself.

When a two-day trial on Sept. 24 and Sept. 26 was initially set for the matter back in July, O’Quinn was represented by defence lawyer Derek Hogan. O’Quinn has since changed lawyers. A five-day preliminary inquiry for Green’s murder case is scheduled to begin Nov. 4.
