William George Parker, 38, was sentenced this morning in provincial court in St. John's. He was given 1.5 times credit for 90 days he's spent in custody.

In handing down his decision, Judge David Orr said the assault caused injuries that were "catastrophic."

The 55-year-old victim suffered a stroke, and brain damage that caused a personality change. He has trouble communicating and was unable to return to work.

Parker pleaded guilty to charges of aggravated assault, assault, mischief by damaging property and failing to attend court.

The victim was in court and after proceedings told reporters that he hopes Parker will learn his lesson about this. Crown prosecutor Lynn Moore said she hopes Parker will get counselling for anger management.

Parker was charged as a result of an incident Oct. 3, 2011, at a worksite at Bay Bulls dump.

A heavy equipment operator, Parker had been training a new employee on a piece of machinery when the victim noticed they had been standing on an unsafe part of the machine.

The victim yelled and told them to get off. Parker refused.

When the victim continued to insist they get down, Parker walked up to the victim and punched him in the face. The victim fell to the ground. Parker then continued to kick the victim several times with his steel-toe boots. The victim suffered a traumatic stroke as a result.

In a previous court appearance, the victim told the court that his life has been severely affected by the assault. He has only partial movement in his hand, he walks with a cane, he has cognitive issues and has trouble speaking.

A four year prison term is NOTHING for what he did to that poor man. This man is obviously a danger to society if he can do this to someone in the blink of an eye. Our justice system sucks. This guy should be jailed for the rest of his life. The man he kicked has a 'life sentence' should the guilty party.

This scumbag should have gotten forty years--not four.Utter disgrace for the justice to impose such a low sentence. This man and all his family got a life's sentence. Scumbag gets four!

There seems to be a problem with our justice system. A man is ruined for life and the assaulter gets only 4 years and adding insult to this, he is given time and 1/2 for time he served.

Assuming the circumstances admitted to in this case are correct he should have gotten 10 years.
