Family of victim angry, says justice not done

Kenny Green pleaded guilty to manslaughter today at Newfoundland Supreme Court in St. John's.

Green had been charged with second-degree murder in the death of Joey Whalen in March 2013 and was to be tried by judge and jury, but he re-elected judge alone today and entered a guilty plea to manslaughter.

Family members of Whalen told reporters they were disgusted. They said they had no idea the Crown agreed to let Green plead guilty to the lesser offence.

Judge William Goodridge dismissed the jury. The trial had been expected to last three to four weeks.

An agreed statement of facts on the case will be presented in court this afternoon.

A joint submission on sentencing will be presented Friday.

The 35-year-old Mount Pearl man is accused of killing 47-year-old Joey Whalen, who died in hospital on March 17, 2013, two days after he was taken there by ambulance from a house on Tessier Place in downtown St John's.

Green had a brief stint of freedom in January of this year, when he was granted bail after a judicial review. However, he was back in custody a day later for breaching court orders.

He was also the target of an attack at Her Majesty's Penitentiary in February, when several inmates assaulted him in the prison's chapel.

Green is represented by defence lawyer Randy Piercey. Sheldon Steeves is handling the Crown prosecution.

    Once again....the justice system doing its finest work...this guy Killed a man...what do you need here...I'm surprised he didn't pled self defence ...WHY IS THIS ALLOWED HERE...I hope they throw the book at him...

    A man beats another person to death and his lawyers get a plea deal...... Newfoundland justice.......gotta love it.....where would we be without lawyers.....
