Hernandez found guilty on two of three charges

Ramon Enrique Hernandez, 27, has been found guilty of sexual assault and breach of probation.
But this morning, provincial court Judge Colin Flynn also found Hernandez not guilty of sexual interference - for touching someone under the age of 16 for a sexual purpose.
Hernandez was charged after an incident in the wee hours of New Years day 2010.
The victim, who cannot be identified, was only 10 years old at the time.
During his four-day trial in May, Hernandez testified he mistook the girl for someone else, an adult.
In his decision, Flynn said he wasn't satisfied the Crown proved beyond a reasonable doubt Hernandez knew the person he touched was under 16.
Hernandez is scheduled to be sentenced Aug. 25.
