A St. John's man has been arrested and charged with a sexual assault in a downtown ally earlier this week.
But Manuel John Clark says he didn't do it.
Clark's lawyer says his client was in the process of arranging things to turn himself in when police arrested him.
Bob Buckingham wouldn't say anything else about the circumstances of his client's arrest, but did say that he would be pleading not guilty to the charges against him.
"There appears to be some evidence or information the possession of the police which if they have it should give them some indication of other leads and hopefully they will look at that information or material and look for possible DNA on that that will lead to the perpetrator," Buckingham said after his client's appearance.
Clark, 34, is facing four charges: sexual assault and assault on the woman, who can't be named due to a publication ban; theft from Sears in March 2007 and failing to appear in court on the shoplifting charges.
"He was shocked and surprised by these charges and he intends to co-operate fully with police … they have the wrong person, Buckingham said. "He's upset. He's distraught. He's shocked. He's surprised."
Clarke's face was plastered in the media this weekend after police issued an arrest warrant for him.
Police issued a request that anyone seeing Clark contact them. Officials also said that Clark was known to police, has a criminal record and is considered violent.
Police were alerted at 3:15 Wednesday morning that a woman was in distress in the laneway towards the east end of Water Street connecting with Harbour Drive.
The woman was returning to a cruise ship she worked on when the assault is reported to have occurred. According to Constantine, she was walking with Clark down the alleyway.
But the woman, not believed to be from the province, did not know him until an hour before the incident, according to police.
It's believed she met him in the street.
Clark will have a bail hearing Tuesday.
