Evan Fry sentenced to six years for home invasion

Evan Fry received a year’s worth of credit for time served, leaving five years on Judge Jacqueline Brazil’s sentence for the 22-year-old from Cupids.

Fry pleaded not guilty to charges all charges stemming from an incident on May 10, 2015.

Fry and Joshua Burton were arrested after police were called to the home of Jean Hillyard, an 85-year-old Bay Roberts resident who lived alone. Burton confronted the woman in her room while holding a knife and eventually left after she pleaded with him to go. Burton pleaded guilty later that year and was sentenced to over six years in prison.

Following a lengthy trial, Brazil found Fry guilty last fall. Crown prosecutor Natalie Payne was seeking a seven-year sentence, while Fry’s lawyer Susan Day requested a 30-month sentence.

In addition to his prison sentence, the judge ordered Fry to have no contact with the victim or Burton. He must also forfeit property obtained by police and submit samples for a DNA databank. Upon his release from prison, Fry will be subject to a firearms prohibition.
