ST. JOHN'S, NL — The man ousted from the mayor's seat last month in Carbonear will have his day in court this week.

Frank Butt's case against the Town of Carbonear is scheduled for 10 a.m. on Wednesday, Jan. 3. According to the docket for the Supreme Court of Newfoundland and Labrador in St. John's, Carbonear lawyer John Babb will represent Butt.

He was barely two months into his first four-year term as the town's mayor when fellow councillors unanimously voted to declare Butt's position vacant.

The decision was made in response to an anonymous letter sent to Municipal Affairs and the town a few weeks before the 2017 general election. It suggested Butt failed to declare conflict of interest when he introduced a motion in 2014 to demolish a commercial property adjacent to a gas station he owned.

The town's lawyer subsequently advised Butt was in conflict on the matter. Following a pair of meetings with the town Butt attended accompanied by a lawyer, council members voted on the matter at the Dec. 12, 2017 meeting.

Butt's only public comments since his ouster from council have been made through a Facebook post. The former mayor said he was disappointed by council's decision and was prepared to appeal it.
