Michael Farnell-McCarthy agreed on May 28 that he would abide by the conditions of a recognizance and had three people sign on to act as his sureties.

Earlier this week all three applied to the provincial court in Corner Brook to withdraw from that role and Farnell-McCarthy found himself back in jail.

Massey Drive man, who tried to evade police, released from custody

The Massey Drive man is charged with two counts of dangerous operation of a vehicle, two counts of driving while disqualified and operation of a vehicle while impaired. The charges were laid on May 27 after he allegedly failed to stop for police on O’Connell Drive.

Police allege he was speeding and followed the vehicle to Tuma Avenue where it stopped in a residential driveway and Farnell-McCarthy exited it in an attempt to avoid police. He was arrested in a residential backyard in close proximity to the vehicle.

In the applications filed with the court the sureties named on his May 28th recognizance allege that he breached the conditions by not returning to his residence at a set time and for not being in the presence of either of the three of them as required.

During a bail hearing on Wednesday those applications were granted.

Farnell-McCarthy was able to secure new sureties and was released from custody.

His next court appearance is set for July 10.
