UPDATED: Arrest warrant for man charged with sex offences dating back to 1980s vacated by Corner Brook court

The arrest warrant issued for Herbert Penney-Flynn in provincial court in Corner Brook Tuesday has been vacated.

The 73-year-old, who currently resides in Toronto, is accused of multiple sex offences alleged to have happened in Corner Brook in the 1980s.

The offences, alleged to have taken place in 1982 and 1988, involve two male victims.

Judge Catherine Allen-Westby had issued the arrest warrant for Penney-Flynn when he was not present for his first appearance on the charges Tuesday morning. At the time, no lawyer was in court to represent him and there had been no indication of any communication from Penney-Flynn explaining his absence.

Later Tuesday, the case was called again after there was communication from Penney-Flynn. The arrest warrant was vacated and he now has his next court appearance scheduled for May 15.

An arrest warrant was issued at provincial court in Corner Brook Tuesday morning for a man now living in Toronto and accused of sexual offences in the western Newfoundland city dating back several decades.

The six counts filed against 73-year-old Herbert Penney-Flynn involve two separate victims, both of them male.

Five of the charges relate to one male and are alleged to have taken place in Corner Brook in July 1982. The offences include indecent assault, buggery, gross indecency, administering a noxious substance with the intent to aggrieve or annoy and administering a stupefying or overpowering drug with the intent to commit an indictable offence.

The sixth charge alleges a single count of sexual assault involving a second male in Corner Brook in June 1988.

The charges against Penney-Flynn were sworn at provincial court in Corner Brook March 20, but the case was called for the first time in open court Tuesday morning.

Penney-Flynn was not present for the court appearance, there was no lawyer there to represent him and no indication of any attempt to contact the court to explain his absence.

Crown attorney Trina Simms, who indicated the prosecution would be proceeding by way of indictment on all six charges, asked Judge Catherine Allen-Westby to issue an arrest warrant for him, which the judge agreed to.
