Delay in case of alleged illegal dumping by Vale

It will be December before a case involving allegations of illegal dumping by Vale Newfoundland and Labrador will move forward.

The next court dates were set this morning at provincial court in St. John’s.

Vale Newfoundland and Labrador is facing three charges relating to the release of liquid waste into Anaktalak Bay, near the Voisey’s Bay mine site, in October 2011. The charges allege violation of the federal Fisheries Act.

The company is facing one count of depositing a deleterious substance in water, one count of failing to report the deposit of a deleterious substance and one count of a breach of the act.

The trial started in May, and was interrupted for voir dire proceedings — to determine the admissability of certain documentation, including email communications and formal reports.

The voir dire proceedings were delayed due to scheduling conflicts and illness, but both the Crown and the company were represented in court today. The voir dire work has been set for Dec. 1-3 and time has been set aside for the case Dec. 10-11.

The trial will continue immediately following the voir dire work.
