A P.E.I. man who grabbed a woman’s buttock and tried to kiss her without her consent was recently sentenced to 60 days in jail.
Brandon David Coakes, 30, appeared before Chief Judge Nancy Orr in provincial court in Charlottetown where he pleaded guilty to one count of assault.
The matter was supposed to go to trial after Coakes was charged with sexual assault and he pleaded not guilty.
Instead, the Crown and defence made a joint sentencing recommendation with Coakes pleading guilty to the lesser offence.
Reading an agreed statement of facts, Crown attorney Emily Campbell told the court Coakes approached the victim from behind, grabbed her buttocks and tried to kiss her, all without her consent.
Coakes has a prior criminal record that included convictions for assault and assault with a weapon.
In accepting the joint recommendation, Orr said Coakes needs to understand he can’t touch someone without their permission.
“It is an assault or worse,” she said.
Along with the jail time, Coakes will be on probation for one year after his release, which included a condition he have no contact with the victim and that he write her an apology letter.
