CHARLOTTETOWN, P.E.I. — A P.E.I. woman who was in a vehicle with property stolen from a residence was sentenced recently to 45 days in jail.

Myra Ashley Clarey, 34, appeared before Judge Nancy Orr in provincial court in Charlottetown for sentencing after previously pleading guilty to possessing stolen property.

The court heard that on Sept. 19 at around 12:30 p.m., the police responded to a report of a break and enter where they found Clarey with two other people.

Clarey was inside a vehicle with property taken from the residence.

The court heard the police executed a search warrant the previous day and the home’s occupant was taken into custody.

At the time of the offence, Clarey was on a conditional sentence from a previous conviction, which included house arrest.

During a previous court appearance, defence lawyer Alex Dalton said Clarey has underlying mental health and substance abuse issues.

The court heard Clarey was on waitlists for addiction and mental health treatment.

Dalton said that until the last year, Clarey had no criminal record.

Clarey told the court she was doing her best to address her underlying issues and she didn’t feel that going back to jail would be the right thing for her.

Orr said she considered that Clarey was on a conditional sentence order when she committed the offence and wasn’t supposed to leave her home.

During the most recent court appearance, Orr said she didn’t think a further conditional sentence was appropriate.
