One of the men charged in connection with the kidnapping and death of 25-year-old Steven Miller in Paradise two years ago has been sentenced to 90 days in jail for assaulting another inmate while he was in custody.
Paul Connolly, 37, appeared via video link from Her Majesty's Penitentiary (HMP) Wednesday when his case was called. He was represented in court by lawyer Rhona Buchan.
Connolly pleaded guilty to assault and breaching conditions of his probation as a result of an incident on July 21 at HMP. While inmates were being served lunch, Connolly grabbed another man by the hair and pushed him backwards after the man had reportedly reached across Connolloy's plate for a kettle.
Pointing to Connolly's 46-page criminal record, including several crimes while he was incarcerated, Crown prosecutor Tannis King suggested a six-month jail term.
Buchan said Connolly should get time served.
But Judge Mark Pike pointed out that while Connolly has served time in custody, it's for the more serious crimes he is charged with.
Just how the 90-day jail term will be factored into the longer sentence he is expected to get in the other case is up to the other judge, Pike said.
Connolly was initially charged with first-degree murder, but changed his plea last week to guilty to the lesser charge of manslaughter. He also pleaded guilty to robbery, unlawful confinement and two counts of breaching a recognizance.
That case is due back in court Friday, when the facts of the case will be presented to the judge.
