Corner Brook sex offender has parole condition modified

The Parole Board of Canada has agreed, in part, to a request by convicted sex offender Johnathan Francis Brake to have the conditions of his parole modified.

Brake, who is originally from Corner Brook, was released on full parole in March after having been on day parole since the fall of 2019.

He sentenced to four years in jail in October 2018 for sexual offences involving a girl who was under the age of 16. The offences occurred between January 2018 and May 2018 in western Newfoundland.

The parole board makes no reference to where Brake is currently living. His original parole conditions stipulate that he is not to enter into a specified imposed boundary to ensure that he has no direct or indirect contact with his victim or her family.

Parole documents note that this was a condition the victim’s family asked for when Brake was released on day parole. They fear an encounter with Brake could further traumatize the victim and the family.

Brake requested a change in the boundary restriction in part to able to visit with other people and for medical reasons.

In its decision on the request, dated May 15, the board said it considered all the file information and is aware of the damage Brake’s actions have caused and how it has impacted the victim and her family.

It said it had to strike the appropriate balance between addressing the concerns of the victim and not being over restrictive in his situation.

The board said it would amend the special condition of the geographic condition to allow him to go into the restricted area for medical purposes. Brake must provide his parole officer with proof for such required visits.

As for the other reasons for the request — including visiting certain people — the board said Brake would have to make alternative arrangements to make them accessible.
